CONDITIONS OF RESIDENCE
The guest self is responsible for the payment of all the costs relating to his/her accommodation at Garden Place, including (though not restricted to), room charges, telephone charges, the costs of all goods supplied to the guest or ordered by the guest, should they not be paid when the fall due.
The guest and/or his principal agrees to pay no later than the time of departure, (unless prior arrangements have been made with the hotel management) the room rate as determined by Garden Place for the period of residence together with the costs of food, beverage, and VAT (if applicable), incurred by the guest and his accompanying party during his/their stay at Garden Place.
A certificate from the manager shall constitute proof of indebtedness of the guest and/or his principal and of the particulars therein for all purposes including any action instituted by Garden Place against the guest and/or his principal.
The guest agrees that after his departure, the hotel may retain goods left behind by him and authorises Garden Place after giving one month’s notice to the address registered by the guest of its intention to do so, to sell same, privately or publicly at Garden Place’s discretion at such price as Garden Place may determine and offset proceeds of such sale against possible indebtedness of the guest or to hold such proceeds or part thereof for a period of 6 months pending any claims by the guest of those proceeds failing which they shall be deemed as having been donated to Garden Place.
The guest hereby agrees on behalf of himself and the members of his accompanying party that it is a condition of his/their occupation of Garden Place that Garden Place shall not be responsible for the loss or damage to any property brought by the guest and his accompanying party upon the premises, whether arising from fire, theft or any cause and by whomsoever caused or arising from the negligence (gross or otherwise) or wrongful act of any person in the employment of Garden Place. The guest and his accompanying party may hand to the management for safekeeping money and/or valuables.
Where appropriate the masculine gender shall include the feminine gender and vice versa and single shall include plural.
The guest hereby consents to the jurisdiction of the Magistrate’s Court having jurisdiction over the guest in any aspect of any proceedings in connection with the stay of the guest and his accompanying party at Garden Place. Notwithstanding the aforegoing Garden Place shall have the right of instituting all or any proceedings connected with such stay at Garden Place in any division of the Supreme Court of South Africa having jurisdiction.
Garden Place shall not be responsible for any damage, accident, drowning nor negligence with regard to guests falling or damaging either themselves or their motor vehicles on said premises.
The guest accepts that it is a criminal offense to remove linen, bedding or any other item belonging to Garden Place and agrees to pay all costs (including legal costs) in the event that items belonging to Garden Place are removed. Any damage, repair or maintenance required other than the general wear and tear, shall be for the guest’s account.
